Logan Paul’s PRIME Faces Lawsuit from NASCAR Driver over Trademark Infringement

Logan Paul is one of the most well-known celebrities in the world right now, who has seen great success in quite a few fields. However, being the owner of PRIME energy drink, he is now facing yet another lawsuit.

According to Dextero, Logan Paul and KSI’s Prime Hydration is facing a lawsuit from NASCAR driver Caesar Bacarella, who claims the brand has infringed on the trademarks of his supplement company, Alpha Prime.

Prime Hydration, which launched in 2022, has quickly gained popularity as a leading drink brand worldwide. However, on July 30, 2024, Bacarella filed a lawsuit alleging that Prime Hydration’s use of the name “Prime” infringes on the trademarks of his company, Alpha Prime.

“This is a civil action for federal trademark infringement (forward and reverse confusion) and unfair competition under the Lanham Act and for Florida law trademark infringement of Bacarella’s ALPHA PRIME trademarks.”

The lawsuit accuses Prime Hydration of federal trademark infringement and unfair competition under the Lanham Act, as well as trademark infringement under Florida law. Bacarella argues that Prime Hydration’s branding is confusingly similar to his Alpha Prime and Prime Bites marks, leading to actual confusion among consumers.

“As described in greater detail below, Defendant’s use of PRIME and its derivatives, falsely suggest affiliation with Bacarella, are confusingly similar to Bacarella’s ALPHA PRIME and PRIME BITES marks, and despite ‘PRIME’ only being on the market for a short time, multiple instances of actual confusion have been discovered.

“The result of these confusingly similar products is actual and a likelihood of confusion as to the origin of the products, harming the reputation and goodwill of Bacarella’s brand.”

Bacarella is seeking a court order to stop Prime Hydration from distributing products that are similar to his own, which may include both their Hydration and Energy drinks.

Besides this lawsuit, PRIME is also facing legal action from the US Olympic and Paralympic Committee and PRIME was also slapped with a $68 million lawsuit to boot. In addition to that, Paul might also get involved in Imane Khelif cyberbullying lawsuit, so it’s definitely not a great time to be Logan Paul.
